Federal Judge Disagrees – FDA Cannot Ban Electronic Cigarette Imports

The FDA first began issuing statements about potential safety  problems that “might” be encountered by e-cigarette users in a manner that suggested the government agency was bowing to pressure exerted by big tobacco.

The dangers of smoking tobacco were scientifically proven over 40 years ago and the first warnings appeared on cigarette packs in response to the proven risks posed by cigarettes. Currently, the U.S. has some of the weakest tobacco warnings in the world. Only last year did the FDA move to regulate tobacco products. The move by the FDA was welcomed by big tobacco which may seem surprising,  It was a wise move by the tobacco companies as strict regulations imposed followed their current practices with few changes required. Those regulations also made it more difficult for competing products to be offered to the public.

After issuing several statements that seem to indicate an intention to ban electronic cigarettes, the FDA established a ban on e-cig products imported from China. In previous statements, the FDA had made claims of safety concerns. However, when imposing the importation ban the FDA expressed concern that flavored e-liquids would induce young people to become addicted to nicotine.

On January 15, 2010, in response to a challenge by e-cigarette companies, a Federal Judge issued a decision against the FDA ban on imported e-cigarettes  In his ruling, the judge criticized the FDA for its aggressive efforts to regulate recreational products as drugs or devices.

The judge referred to the FDA’s new tobacco division created with the passage of tobacco legislation last year. The legislation allows the FDA to regulate traditional tobacco products by regulating contents and marketing claims. The court pointed out that same legislation would apply to electronic cigarettes.

The relationship of the FDA to big tobacco and pharmaceutical companies may come under closer scrutiny due to this court decision. Billions of dollars flow into government coffers from taxes on tobacco both at the federal and state levels. The regulations proposed adhere in large part to current practices of tobacco manufacturers making it more difficult for small companies to compete with alternative products. The entire focus of big tobacco might be quite different had they become involved in creating and offering alternatives to smoking.

If the concern of the FDA were truly to protect the health of the public, why has the agency never proposed banning tobacco smoking?  If electronic cigarettes are as safe as initial testing seems to indicate, why is the FDA pressing for a ban on the products rather than conducting testing to see if e-cigs offer a safer alternative to tobacco?  The agenda seems clear.

In 1942, a study conducted at the University of Chicago’s Billings Hospital showed inhalation of vaporized propylene glycol in lab mice might present such diseases as pneumonia and other respiratory illnesses. Follow-up studies to determine long term effects were conducted on other animals including monkeys. What Would Happen If All Smokers Switched To Electronic Cigarettes?   Chaos And Confusion or Improved Health And Lifestyle?

Tobacco farmers would need to raise a different crop and the large tobacco subsidies from government would disappear. This 31 cent increase in tobacco tax will create an estimated additional 25 million dollars annually for the state.

States would lose significant income from tobacco tax but would gain revenue from sales tax on electronic cigarettes. More significantly, medical costs would begin to decline as fewer people would suffer from smoking related illness. We know smoking cigarettes can cause cancer, contribute to heart disease and emphysema and is a causal factor for other major illnesses. Products to remove the tobacco odor from furniture and curtains would disappear from the shelves at the grocery. The mission of the ECA is to provide a collective voice for electronic cigarette organizations and providers. This is accomplished by providing accurate information and the tools needed to the media, policy makers and opinion leaders in the country. The Association is aimed at instituting industry-wide standards and a code of conduct that will both educate and reassure the public and legislators at all levels of government on the use and safety of e-cigs.

From the time they were introduced in 2003 electronic cigarettes have been under attack by the powerful lobbyists of big tobacco and large (profitable) pharmaceutical firms. After significant pressure from those lobbies, the FDA conducted a very narrow testing of e-cigs. The results of the FDA test found a trace amount of a high risk compound but did not compare that result with similar testing of tobacco cigarettes. Tobacco companies use that limited FDA study to push for a ban on electronic cigarettes. The formation of the Electronic Cigarette Association was to combat the misinformation being spread by tobacco and pharmaceutical companies.

The focus of information for the ECA is to offer the electronic cigarette as a safer and cheaper alternative to tobacco products. To do this, the Association encourages users to share their stories and to contact their Legislators in Congress.

The misinformation about e-cigarettes is not unusual when a new and innovative product is introduced. The serious health risks of smoking tobacco are well known yet for generations smoking tobacco was fully accepted in our society. Ashtrays were provided everywhere you went and television and print commercials linked smoking cigarettes to a lifestyle of glamour and sophistication.

The serious health risks of smoking and the number of ingredients, additives and compounds in smoke are now understood. In just a few years smoking tobacco has changed from being an acceptable habit to being socially unacceptable. More and more entertainment venues ban smoking, public buildings are now smoke-free and some even complain at smokers who light up outdoors.

Electronic cigarettes are a product meant to provide an alternative to tobacco. E-cigs have come under attack from large companies who stand to lose profits with the rapid growth of electronic cigarette use. E-cigs are also condemned by some legislators and organizations who want smoking stopped altogether. One group is profit motivated while the second is health related yet they share the goal of banning the sale of e-cigs.

Forty years ago the surgeon general declared tobacco smoking a heath hazard yet only last year was action begun to place tobacco products under the regulation of the FDA.  The health risks of smoking have been well known and documented but the FDA has never once suggested banning the use of tobacco. Electronic cigarettes have been available for a short time only and yet the FDA is hinting at banning the product altogether. The Electronic Cigarette Association hopes that with self regulation of e-cig suppliers and with dissemination of accurate information, they will be able to keep electronic cigarettes on the market for the public’s use.

While no one can argue that these things aren’t true, there are still millions of people on the planet who smoke both socially and on a daily basis. Why? Because it’s not only an addiction, it’s a habit, more importantly-a social habit.

If you’re a smoker than you know the tight restrictions and bans that are placed on cigarettes. Smoking was once a part of many people’s everyday lives. Pregnant women smoked and drank daily because no one told them not to. Smoking was permitted on airplanes, in movie theaters, the workplace and even in hospitals.

Today, smokers are confined to their homes, cars and designated areas outside if they feel like lighting up. With all these restrictions, imagine if we lived in a place or time where you could enjoy smoking anywhere? If you could sit at your desk at work or have a drink in a bar while smoking a cigarette without disturbing others, would you do it? Well, people already are.

The Electronic Cigarette or E-Cig was introduced to the world about 5 years ago, and in the past couple of years has gained a lot of momentum. The government has no problem taxing smokers, because they think smokers will still buy cigarettes regardless of the price. But lately, this has become less of a truth. Now, many smokers are turning to Electronic Cigarettes in the hopes of not only saving money, but their health as well.

Electronic Cigarettes are permitted in most public places, and smokers no longer have to feel like second class citizens because they want to partake in the choice to smoke. No longer do they need to feel embarrassed or think they are disturbing others while engaging in their choice.

The new lifestyle product that is the Electronic Cigarette allows smokers to rejoin the rest of the world without having to explain themselves to others or give up something they enjoy doing. Hopefully, the rest of the world will soon catch up and begin to accept smokers again like they did years ago.
